These Terms & Conditions (“Terms”) govern your access to and use of our AI-powered employee listening platform State of Mind AI (“Platform”), including its features, functionalities, and related services. By accessing or using the Platform, you agree to comply with and be bound by these Terms. If you do not agree with these Terms, please do not use our services.

  • User: Any individual or organization accessing or using our Platform.
  • Customer: Organizations that have subscribed to or purchased access to our Platform.
  • Content: Any data, information, text, reports, or materials made available through the Platform.
  • AI Insights: Automated, AI-driven recommendations and analytics provided within the Platform.

 

3. Use of the Platform

 

3.1 Eligibility

To use our Platform, you must be at least 18 years old and authorized by your organization to access employee engagement tools.

 

3.2 Authorized Access

Customers and users are responsible for ensuring only authorized personnel access their accounts. You must keep login credentials confidential and notify us immediately of any unauthorized access.

 

3.3 Acceptable Use

You agree to use the Platform solely for lawful and business-related purposes, including:

– Conducting employee engagement surveys and conversations.

– Gaining AI-driven insights to improve workplace culture.

– Implementing action plans based on employee feedback.

You must not:

– Use the Platform for any illegal or unauthorized purpose.

– Transmit malware, viruses, or other malicious code.

– Interfere with the proper functioning of the Platform.

– Misuse AI-generated insights for discriminatory or unethical practices.

 

4. Features & Capabilities

 

Our Platform provides customizable solutions for employee engagement, including but not limited to:

  2. Custom Surveys– Create tailored engagement surveys, including lifecycle and 360-degree feedback.
  3. AI-Driven Action Planning – Turn insights into actionable strategies with automated recommendations.
  4. Multi-Channel Deployment – Distribute surveys via email, Slack, Teams, WhatsApp, and more.
  5. Enterprise-Grade Customization – White-label branding, role-based access, and security controls.
  6. Data Analytics & Reporting – Generate real-time insights at the employee, manager, HRBP, and leadership levels.

 

5. Data Privacy & Security

 

5.1 Data Collection & Usage

We collect and process employee feedback and related data as part of our services. Our AI-driven insights anonymize responses where required to maintain confidentiality.

 

5.2 Data Ownership

Customer organizations retain ownership of their data. We act as a data processor and do not sell or share customer data with third parties except as required for service delivery.

 

5.3 Security Measures

We employ industry-standard security protocols to protect data integrity, including encryption, access controls, and compliance with applicable data protection laws.

 

6. Subscription & Payment Terms

 

6.1 Subscription Model

Our Platform operates on a subscription-based pricing model. Customers must adhere to their selected plan’s payment terms.

 

6.2 Refund Policy

We do not offer refunds for unused portions of subscriptions unless explicitly stated in a separate agreement.

 

6.3 Plan Modifications

Customers may upgrade or downgrade their plans per their contractual agreements.

 

7. Intellectual Property

 

7.1 Ownership

All trademarks, copyrights, and proprietary software related to the Platform remain the property of GOWIF Technologies Private Limited. Customers are granted a limited, non-transferable license to use the Platform for internal business use.

 

7.2 Restrictions

Users may not copy, distribute, reverse-engineer, or resell any part of the Platform without prior written permission.

 

8. Limitation of Liability

 

To the maximum extent permitted by law, we are not liable for indirect, incidental, or consequential damages arising from the use of the Platform. Our total liability under these Terms shall not exceed the unused subscription fees from the paid subscription fee by the Customer in the past 12 months.

 

9. Termination

 

We reserve the right to suspend or terminate access to the Platform if a user violates these Terms or engages in misuse of the services. Customers may terminate their subscription per their contractual obligations.

 

10. Governing Law

 

These Terms shall be governed by and construed under the laws of India, Bangalore. Disputes shall be resolved through arbitration or courts in Bangalore, India.

 

11. Changes to These Terms

 

We may update these Terms from time to time. Continued use of the Platform after changes signifies acceptance of the revised Terms.
